We took All Aboard Sanding to VCATVCAT Reference: C7015/2021APPLICANT: RJ And Sons (aust) ACN:161 048 451RESPONDENT: Daniel White ABN:92 417 708 512 t/as All Aboard SandingDATE OF HEARING: 27 February 2023We engaged All Aboard Sanding to sand and coat our kitchen/loungeroom timber floors, as we were selling our property and needed them to look great for the marketing, sale and handover process. Daniel applied the Bona White Primer and Bona Traffic system, and we specified the look as a light blonde colour.Approximately 6.5 months after paying Daniel for this service, we discovered that a dark brown stain had damaged the timber underneath the rug in the lounge room. Our guess was that this was caused by sunlight, and we contacted Daniel that same day and requested for him to visit the property to help explain this dark brown staining damage, plus see what remedy might exist to fix it. Daniel visited our property approximately 4 weeks later after multiple texts and emails, where he confirmed it was sun damage in his opinion. Daniel offered only to sand the floor to remove the existing finish and prepare the surface for new coatings, to be applied by someone else, as he would not offer the application of any products or pay for the process to be done. We offered as a potential way forward that Daniel not only resand the damaged floor, but also coat and protect the floor using a product other than Bona, which would resolve the matter for us. Daniel did not agree to this request. At that point, we engaged another floor sanding business to sand and recoated our floor.We lodged a case with VCAT to recover the cost of Daniels’ invoice, which would subsequently cover the expense we incurred by engaging another floor sanding business to resand and recoating the entire floor again. We presented the case to VCAT that Daniel had handed us a Bona Care guide brochure which promoted the use of rugs to protect the Bona floor product. We also mentioned that we had used rugs in the loungeroom for years and never had any stains like this occur with the previous protective coating on the timber floor. Daniel stated in email to us that he himself has timber floors and that he doesn’t use rugs because he knew discolouration would occur from UV, and that he or the manufacturer would not be liable for this. Daniel stated in his points of defence to VCAT that discolouration will always certainly occur when a rug is placed in a high UV-exposed area, which will cause the area to darken under rugs.It was our belief that because Daniel did not provide any information about the risk of UV staining damage prior to his coating, or adequate care instructions after completing the work, that we as consumers following the documentation he did provide (which said to use rugs to protect the floor), that we should have had some level of consumer protection. It was also our belief that 6.5 months is an unacceptable amount of time for the floor to experience UV staining damage to the degree that it did, and that there should have been some level of warranty or consumer protection for us.The VCAT member who presided over the case ruled that Australian Consumer Guarantee Section (60) Due Care was not applicable because it protects “how the service is rendered, not how you care for the product after you receive it”. The legal finding was that even though Daniel had seen the rug on the floor after the job was completed, and even though the “likely cause of the stain was UV”, and despite the fact Daniel supplied Bona brochures advising the use of rugs to help protect the timber floor, we as the applicant were “unable to displace the burden of proof” and that it was deemed “beyond human control”. As such, we bore the full costs of resanding and recoating the floor to fix the dark brown UV staining damage.
